Expungement and Information Processing (EIP)

This division assists in the processing of District Court petitions and orders for expungement. It also serves as support within District Criminal courtrooms.

Expungement Certification Process

Kentucky law requires every petition for expungement of a conviction to include a certificate of eligibility for expungement. Individuals who wish to have their criminal records (charges/case) expunged must complete the expungement certification process to determine if they are eligible for expungement. A certification is not required for dismissals and acquittals.

The Kentucky State Police oversee this process in conjunction with the Administrative Office of the Courts (AOC). Both agencies must run criminal record reports on the person petitioning for the expungement. The KSP will certify the eligibility of the expungement request.

Individuals who obtain an expungement certification may then file a petition in EIP. The petition is then reviewed. Once a court order for expungement is entered, EIP distributes the order and expunges the electronic record.

Petitioners with guilty convictions will be charged a $100 fee per case within the department. The EIP Division takes payments via:

  • Money order made out to: “David L. Nicholson, Circuit Court Clerk”
  • Cash
  • Credit or Debit card
  • Certified cashier’s check made out to “David L Nicholson, Circuit Court Clerk”

Donate Life Kentucky Trust is a 501(c)(3) nonprofit organization dedicated to addressing the unmet needs of the impacted by donation and transplant. Founded in 1992, by the Circuit Court Clerks of Kentucky, Donate Life Kentucky Trust (Trust) focuses on public education and donor registration efforts to save and heal lives. The Trust also provides critical financial support to transplant patients and donor families by providing access to travel, lodging, medication, mental healthcare, and funeral expenses.
