This division assists in the processing of District Court electronic and manual citations, petitions and orders for expungement, and serves as recommenders in District Criminal courtrooms.
This department processes the criminal-traffic citations issued in Jefferson County. EIP reviews all District Criminal non-arrest citations and makes any corrections necessary regarding the scheduling of the court date or the coding of the violation. EIP will then ensure the case is created, scan the citation into the system, and send court notices to the parties involved if changes are made. Next, the department prepares the case files and delivers the files to District Criminal.
Recommenders enter the recommendations of the County Attorney into the BenchPro judicial computer system. If the judge accepts the recommendation, this becomes the judge’s order.
Expungement Certification Process
Kentucky law requires every petition for expungement of a conviction to include a certificate of eligibility for expungement. Individuals who wish to have their criminal records (charges/case) expunged must complete the expungement certification process to determine if they are eligible for expungement. A certification is not required for dismissals and acquittals.
The Kentucky State Police oversee this process in conjunction with the Administrative Office of the Courts (AOC). Both agencies must run criminal record reports on the person petitioning for the expungement. The KSP will certify the eligibility of the expungement request.
Individuals who obtain an expungement certification may then file a petition in EIP. The petition is then placed on the docket for review. Once a court order for expungement is entered, EIP distributes the order and expunges the electronic record.
