District Civil – Small Claims – Probate

The District Civil Division has four departments: District Civil/Small Claims, Probate, Juvenile/Interpersonal Protective Orders, and Mental Health.

New Extended Hours Coming — Effective March 1, 2023, the District Civil/Small Claims Division will close at 4:30 p.m. daily.

District Civil/Small Claims

The District Civil Division handles the intake and processing of civil cases. Note: Civil Cases usually require an attorney. This department processes civil complaints for damages up to $5000, forcible entry/detainer (eviction) petitions and post-judgment remedies such as garnishments and executions.

This department also processes administrative board appeals, student hardship driver’s license cases and petitions for damages pertaining to childhood sexual abuse/assault.

The Small Claims Division handles the intake and processing of small claims for complaints not exceeding $2,500. Typically, cases in this court are filed by pro se (self-represented) individuals (proceeding without assistance from an attorney) dealing with non-criminal legal issues. Probate

The Probate division processes pleadings and judicial orders that validate wills, appoint executors or administrators, and settle estates. This department also handles estate cases, guardianship for individuals under age 17, trusts, curatorships, infant settlements under $10,000, and name changes for adults and children. In addition, this division processes corrections to death certificates. Birth certificate corrections should be filed in Circuit Court — (502) 595-3007.

Eviction Court

  1. Beginning June 15, 2020, Jefferson County Eviction Court will resume dockets remotely Monday through Thursday at the following times:
  • 9:00 a.m.
  • 10:00 a.m.
  • 11:00 a.m.

There will be a special hearing docket held on Fridays from 9:00 – 11:00 a.m. for cases that are deemed to require an in-person hearing.

All cases will be heard in Courtroom 308. However, attorneys, landlords, witnesses and defendants are to appear in-person or remotely. All cases are set for a hearing. Please have available all witnesses necessary on the date of the hearing.

  1. All eviction dockets shall be recorded in the JAVS and/or Zoom platform for the official court record of the proceedings.
  2. The Jefferson County Sheriff’s Office will be posting the Eviction Court video/telephone notice with the Eviction Notice.
